Warren Asks GAO To Review CFTC Staff Cuts As Crypto Duties Grow

A shrinking derivatives regulator is being asked to police a larger market agenda.

Sen. Elizabeth Warren's Tuesday letter to the Government Accountability Office requested a review of Commodity Futures Trading Commission staff cuts after Banking Dive placed the agency's workforce decline at 25% since President Donald Trump took office in January 2025.

The request puts the CFTC's staffing base against two expanding policy areas: prediction markets, where the agency asserted exclusive jurisdiction in April, and crypto market structure legislation moving through Congress.

Warren's letter argued that both areas could require significant CFTC resources.

Enforcement Totals Fell Alongside Staffing Cuts

The enforcement record gives the staffing complaint its main financial anchor.CFTC brought 58 enforcement actions in 2024, while Reuters figures cited by Banking Dive put the year leading up to January 2026 at 11 enforcement actions and $1 billion in monetary relief, according to Banking Dive.

Warren's request asks the GAO to examine whether cuts affected the CFTC's ability to fulfil its enforcement capabilities and broader mandate over American derivatives markets.

The agency has governed futures and options contracts traded on regulated exchanges since 1974, and it has overseen swaps since the 2010 passage of the Dodd-Frank Act.

Prediction Markets And Crypto Bills Add Workload Pressure

Prediction-market oversight adds to the CFTC workload because the agency asserted exclusive jurisdiction over that market in April.

The agency is not only handling its traditional futures, options and swaps remit; Warren's letter treats the April assertion as another demand on the same enforcement and policy staff.

Crypto legislation would add another resource claim if Congress assigns the CFTC a larger market-structure role.

The letter does not quantify the staff or budget required for that work.

GAO Review Would Test Whether Cuts Followed Federal Rules

The requested review covers more than the raw headcount.

Warren's Tuesday letter set three questions for GAO: compliance with federal rules, effects on the agency's mandate, and any connection between the staff cuts and fraud, waste or abuse at the CFTC.

A GAO spokesperson acknowledged receipt of the letter and explained that the office has a process for deciding whether to take up work and when.

Banking Dive did not receive a CFTC response by publication time, and the agency's formal explanation for the staffing cuts was not available.
